This website is provided by 118 118 Money, which is the trading name of Madison CF UK Limited (“Madison”) and an affiliate of 118 118. Madison is a company registered in England and Wales under company number 08393840. We have our registered office at The Clubhouse, Holborn Circus, 20 St. Andrew Street, London EC4A 3AG. 118 118 Money is authorised and regulated by the Financial Conduct Authority (Firm Reference Number 741774).

For the purposes of these terms and conditions of use (“Terms of Use”), “you”, “your” and “yours” means the person(s) who access the 118118 Money.com website (the “Site”). References to “we”, “us” and “our” means Madison.

Whilst every effort has been made to ensure the accuracy of the information and material contained on the Site, Madison assumes no responsibility for, nor gives any guarantee, undertaking or warranty concerning the accuracy, completeness or up to date nature of the information provided on the Site nor does it accept any liability whatsoever arising from any errors or omissions.

The Site is made available by Madison and its affiliated companies and may also be provided or located on third party websites and/or computer servers.

A. ACCEPTANCE OF TERMS

Whether you make use of the Site as a guest or as a registered user, by accessing the Site, you agree to these Terms of Use. Madison reserves the right to change the Terms of Use from time to time at its sole discretion. Your use of the Site will be subject to the most current version of the Terms of Use posted on the Site at the time of such use. If you breach any of the Terms of Use, your authorisation to use the Site automatically terminates and you must immediately destroy any materials downloaded or printed from the Site (with the exception of the Credit Agreement and other material related to the Services). If you do not agree with these Terms of Use, you must not use the Site.

All transactions for the supply of services and products concluded via the Site (“Services”) will be governed by a separate credit agreement which you will be required to enter into to complete the transaction (“Credit Agreement”).

This Site is for reference only. No statement, information, opinion or material on this Site shall constitute an offer (with the exception of the Credit Agreement), recommendation, or advice of any kind whatsoever. You need to satisfy yourself as to the accuracy and suitability of any Service before entering into any contract. G. LIABILITY

To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude liability to you whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of revenues, profits, the use of money, goodwill, or anticipated savings, for any loss or destruction of data or (without limitation) for any indirect or consequential loss or damage of any kind, whether any such loss is reasonably foreseeable or not arising in connection with your use of the Site for any reason.

Nothing in these Terms of Use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Site or any content on it, whether express or implied.

Different limitations and exclusions of liability will apply to liability arising as a result of the supply of Services to you, which will be set out in the Credit Agreement.

H. GENERAL

By using the Site you indemnify, defend and hold harmless Madison from and against any and all losses, claims, damages, costs and expenses or legal proceedings which are brought or threatened against Madison by a third party resulting from your breach of these Terms of Use.

We will notify you of any such claims or proceedings and keep you informed as to the progress of such claims or proceedings and reserve the right to assume or participate, at your expense in the investigation, settlement of defence of any such claim or action.
These Terms of Use and any Credit Agreement entered into by you constitute the entire agreement between Madison and you and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between the parties, whether written or oral, relating to its subject matter. Each party agrees that it shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms of Use. Each party agrees that it shall have no claim for innocent or negligent misrepresentation based on any statement in these Terms of Use.

We shall have the unrestricted right to assign, licence or otherwise dispose of its rights and obligation (in whole or in part) under these Terms of Service.

We may vary these Terms of Use and any information, materials, Documents and Content on the Site at any time. We shall ensure that the most recent version of these Terms of Use is situated on the Site at www.118118Money.com. Any such change shall take effect from the date that the new Terms of Use are posted on the Site. Failure by Madison to enforce any of its rights under these Terms of Use is not to be taken as or deemed to be a waiver of that right unless we acknowledge the waiver in writing.

These Terms of Use are not intended to be for the benefit of, and shall not be exercisable by any person under the Contracts (Rights of Third Parties) Act 1999 or otherwise, except Madison’s affiliated companies. Part or all of any clause of these Terms of Use that is unenforceable or illegal is to be severed from these Terms of Use and does not affect the enforceability of the remaining provisions of these Terms of Use.

These Terms of Use shall be governed by English Law and subject to the exclusive jurisdiction of the Courts of England and Wales.
